This policy explains how we collect, use, and protect your personal data when you enter the “Win 1 Year Student Accommodation Free At Timber Yard” competition (the “Competition”). As Data Controller, the Organiser determines the purposes and means of processing your personal data and is responsible for ensuring compliance with the UK GDPR and the Data Protection Act 2018.

When you enter the Competition, we collect the following categories of personal data:

- Consent: When you provide explicit opt-in consent for marketing communications via the checkbox on the entry form.
- Contractual Necessity: To administer the Competition and deliver the prize to the winner, which is necessary for the performance of the contract formed when you enter the Competition.

- HOW WE USE YOUR DATA

Important: Entry into the Competition does NOT automatically subscribe you to marketing communications. - DATA SHARING
We do not sell your personal data to third parties. We may share personal data in the following circumstances:
- The Landlord/Accommodation Provider: To facilitate the tenancy.
- Verification Services: To confirm student enrolment status and Right to Rent eligibility.
- Regulators and Advertising Standards: If required by the Advertising Standards Authority (ASA), Gambling Commission, or other regulatory bodies. This includes providing winner information to the ASA upon request to ensure compliance with advertising standards.
- YOUR RIGHTS
Under the UK GDPR and the Data Protection Act 2018, you have the following rights regarding your personal data:

- The right to rectification of inaccurate personal data
- The right to erasure (“right to be forgotten”) in certain circumstances

- DATA RETENTION
We will retain your personal data only for as long as necessary to fulfil the purposes for which it was collected:
(a) Non-Winning Entrants: Personal data of non-winning entrants will be securely deleted 6 months after the winner is announced. This retention period allows us to address any queries or disputes regarding the Competition and to comply with our legal obligations under consumer protection and advertising standards regulations.
(b) Winner: The winner’s personal data will be retained for the duration of the tenancy agreement plus 5 years thereafter. This extended retention period is necessary to:
(i) Fulfil our contractual obligations relating to the tenancy
(ii) Comply with legal and regulatory requirements, including tax, accounting, and Right to Rent obligations
(iii) Defend against potential legal claims.
(c) Marketing Consent Data: If you opted in to marketing communications, we will retain your contact details until you withdraw consent or for 3 years from your last interaction with our marketing materials, whichever is earlier.
After these retention periods expire, your personal data will be securely deleted or anonymised in accordance with our data retention and destruction procedures.
- WINNER PUBLICITY AND REGULATORY COMPLIANCE
(a) Publication of Winner Information: In compliance with the Committee of Advertising Practice (CAP) Code and Advertising Standards Authority (ASA) requirements for promotional competitions, we are required to demonstrate that prizes have been awarded. Accordingly, we will make available the winner’s surname and county (or country, if outside the UK) for a reasonable period following the Competition.
(b) Right to Object to Public Disclosure: If you win and object to public disclosure of your information, you may contact us using the contact details mentioned in this policy. However, please note that even if you object to public disclosure, we remain obligated to provide winner information to the Advertising Standards Authority (ASA) upon request to demonstrate compliance with advertising standards. This is a regulatory requirement, not marketing activity.
(c) Basis for Processing: Publication of winner information is necessary for compliance with legal and regulatory obligations under the CAP Code and to fulfil our legitimate interests in demonstrating the Competition was conducted fairly and prizes were awarded as advertised.
- INTERNATIONAL PARTICIPANTS
(a) Jurisdiction: This Competition and the processing of personal data are governed by the laws of England and Wales. By entering the Competition, you agree that any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
(b) International Compliance: If you are entering from outside the United Kingdom, you are responsible for:
(i) Ensuring your entry and participation comply with the laws of your local jurisdiction, including any local data protection laws
(ii) Obtaining any necessary visas, immigration permissions, or other authorisations required to claim and use the prize (accommodation in the UK)
(iii) Understanding that we process data in accordance with UK data protection law, which may differ from the data protection laws in your country
(c) Cross-Border Data Transfers: If you are located outside the UK, your personal data will be transferred to and processed in the UK. By entering the Competition, you acknowledge and consent to this transfer.
