Terms and Conditions

TITLE: Free To Enter To Win Free Student Accommodation For 1 Entrant at Timber Yard, Bristol, UK.

PROMOTER: Silverthorne Locke Ltd, a company registered in England and Wales with company number 13794033 whose registered office is at c/o The Temperance House, Bristol Road, Wraxall, BS48 1LQ (the “Promoter”).

ORGANISER: Design & Market Ltd, a company registered in Scotland with company number 872854, whose registered office is at Great Michael House, 14 Links Place, Edinburgh, EH6 7EZ, acting solely as competition organiser and administrator on behalf of the Promoter (the “Organiser”).

 

  1. THE COMPETITION

1.1       The title of the competition is: The Free To Enter To Win Free Student Accommodation For 1 Entrant at Timber Yard Student Accommodation, Bristol, UK.

1.2       This is a free-to-enter prize draw. No purchase is necessary to enter or win.

 

  1. ELIGIBILITY

2.1       The competition is open to persons aged 18 years or over who: (a) will be attending further education at a college or university in Bristol or within a 15 mile radius of the Timber Yard project during the prize period (7 September 2026 to 28 August 2027); or (b) have a child who will be attending such further education during the prize period and who is aged 18 years or over. This includes both UK residents and international entrants, except:

(a)        employees of the Promoter or its holding or subsidiary companies.

(b)        employees of agents or suppliers of the Promoter, who are professionally connected with the competition or its administration; or

(c)        members of the immediate families or households of (a) and (b) above.

2.2       International entrants are permitted to enter this competition. However, international entrants acknowledge and agree that:

(a)        they are solely responsible for ensuring compliance with all visa and immigration requirements necessary to legally reside in the United Kingdom for the duration of the prize period;

(b)        they are solely responsible for ensuring compliance with any laws or regulations in their home jurisdiction regarding participation in prize draws, competitions, or receipt of prizes;

(c)        the Promoter and Organiser shall not be liable for any visa denials, immigration issues, or inability to take up the prize due to legal restrictions in the winner’s home country or the United Kingdom;

(d)        failure to obtain necessary visas or immigration clearance will not entitle the winner to any compensation, alternative prize, or cash equivalent; and

(e)        if an international winner cannot take up the prize due to visa or immigration issues, the Promoter reserves the right to award the prize to an alternative entrant.

2.3       In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter.

2.4       The Promoter will not accept competition entries that are:

(a)        automatically generated by computer;

(b)        completed by agents;

(c)        completed by third parties (unless a parent or grandparent of a qualifying student); or

(d)        illegible, altered, reconstructed, forged or tampered with.

2.4       Limit of one entry per person. Joint submissions are not allowed. Entries on behalf of another person will not be accepted, except that parents or grandparents may enter on behalf of a qualifying student in accordance with clause 2.3(c) above, provided that if such entry wins, the prize must be taken up by the qualifying student and not the parent or grandparent who entered.

 

  1. HOW TO ENTER

3.1       The competition will run from 12 Noon on 19th January 2026 (the “Opening Date”) to 12 Noon on 27th April  (the “Closing Date”) inclusive.

3.2       All competition entries must be received by the Promoter by no later than the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

3.3       To enter the competition: “Complete the online entry form on the website here: https://www.timberyardbristol.com/win-a-free-student-room-in-bristol/ and submit your name, email address and mobile phone number.

3.4       No purchase necessary. There is no charge to register for use of the website.

3.5       The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

 

  1. THE PRIZE

4.1       The prize is: One academic year (7 September 2026 to 28 August 2027) accommodation at the Timber Yard in a Standard Ensuite Room, that can be selected from the existing stock subject to availability or in circumstances where availability has become limited will be reserved by the organiser.

4.2       Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.

4.3       The prize is not negotiable or transferable. No cash alternative is available.

4.4       The prize does not include: travel expenses to or from the accommodation; travel insurance; food or drink; personal expenses; any paid services within the Timber Yard scheme such as laundry services or vending; any furnishings that do not come as standard with the room including but not limited to bedding, cutlery, or soft furnishings; utility bills (unless expressly included in the standard accommodation package); service charges; council tax (if applicable); or any other costs or expenses not expressly stated as included by the Promoter.

4.5       Tax Liability: The winner is solely responsible for any and all tax implications arising from winning or using the prize, including but not limited to any benefit-in-kind tax, income tax, capital gains tax, or other taxation that may be assessed by HM Revenue & Customs or any other tax authority in any jurisdiction. The winner acknowledges that the prize may constitute a taxable benefit and agrees to seek independent tax advice regarding their personal tax position. The Promoter and Organiser will not provide any compensation, reimbursement, or payment in respect of any tax liability incurred by the winner. The winner agrees to indemnify and hold harmless the Promoter and Organiser against any claims by tax authorities relating to the winner’s tax obligations in respect of the prize.

4.6       Financial Indemnity: The winner agrees to indemnify and hold harmless the Promoter and Organiser against any claims, costs, expenses, or liabilities arising from: (a) the winner’s use or occupation of the accommodation; (b) any damage caused by the winner to the accommodation beyond normal wear and tear; (c) any breach by the winner of the accommodation terms and conditions or house rules; or (d) any tax liabilities or financial obligations arising from the prize.

 

  1. WINNER SELECTION

5.1       A winner will be chosen by a random draw performed by a computer process within 7 days of the Closing Date.

5.2       The decision of the Promoter is final, and no correspondence or discussion will be entered into.

 

  1. WINNER NOTIFICATION AND CLAIMING THE PRIZE

6.1       The winner will be contacted by email or telephone using the details provided with the entry within 14 days of the Draw Date.

6.2       If the winner cannot be contacted or has not claimed their prize within 7 days of the notification, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

6.3       The Promoter does not accept any responsibility if you are not able to take up the prize.

6.4       Verification and Eligibility Confirmation: Before the prize is awarded, the winner must provide satisfactory proof of eligibility including but not limited to: (a) proof of age and identity; (b) proof of acceptance or enrolment at a qualifying educational institution in Bristol or within a 15 mile radius of Timber Yard; (c) for international winners, evidence of legal right to reside in the UK for the prize period or confirmed visa application in process; and (d) any other documentation reasonably requested by the Promoter. Failure to provide such proof within 14 days of request will result in disqualification and the prize being offered to an alternative entrant.

6.5       Winner Publicity and Media Rights: By accepting the prize, the winner grants to the Promoter and Organiser (and their respective agents, representatives, and assigns) the irrevocable, perpetual, worldwide, royalty-free right and permission to:

(a)        use, publish, reproduce, and distribute the winner’s name, photograph, video footage, voice, likeness, image, and biographical information;

(b)        use, publish, and reproduce any statements, testimonials, or comments made by the winner about the competition, prize, or accommodation;

(c)        use, publish, and reproduce images, video footage, or recordings of the winner at the accommodation, during handover events, or at related promotional events;

for advertising, promotional, marketing, publicity, and trade purposes in any and all media now known or hereafter developed (including but not limited to print, broadcast, online, social media, websites, and promotional materials) without further compensation, notice, review, or approval.

The winner waives any rights to inspect or approve the finished materials or the use to which such materials may be applied.

6.6       The winner agrees to participate in reasonable promotional activities as requested by the Promoter, including but not limited to photographs, video recordings, interviews, and social media posts. Failure to participate in such promotional activities may result in forfeiture of the prize.

6.7       If the winner objects to the use of their name, image, or likeness for promotional purposes, they must notify the Promoter in writing within 7 days of being notified as the winner. In such case, the Promoter reserves the right to withdraw the prize offer and select an alternative winner. No compensation or alternative prize will be provided to a winner who objects to publicity requirements.

 

  1. LIMITATION OF LIABILITY

7.1       Insofar as is permitted by law, the Promoter and Organiser, and their respective agents, distributors, employees, and representatives will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, Organiser, or their respective agents, distributors, or employees. Your statutory rights are not affected.

7.2       Organiser’s Limited Role: The Organiser’s role is limited to administering the competition entry process, conducting the prize draw, and notifying the winner only. The Organiser is not responsible for:

(a)        providing, delivering, or managing the prize;

(b)        the condition, quality, or suitability of the accommodation;

(c)        any acts or omissions of the Promoter, the accommodation provider, or their respective staff;

(d)        any issues arising during the winner’s occupation of the accommodation;

(e)        any disputes between the winner and the Promoter or accommodation provider;

(f)         verification of winner eligibility beyond the initial entry requirements;

(g)        enforcement of accommodation terms, house rules, or residential agreements; or

(h)        any tax, legal, or immigration matters relating to the prize or winner.

7.3       The Promoter is solely responsible for the provision and delivery of the prize, the condition and management of the accommodation, and all matters relating to the winner’s occupation of the accommodation.

 

  1. DATA PROTECTION AND PRIVACY (GDPR COMPLIANCE)

8.1       The Organiser will only process your personal information as set out in the [Link to Company Privacy Policy].

8.2       By entering, you acknowledge that the Promoter will use your personal data to administer the competition.

8.3       Marketing: You will not be added to our marketing mailing list unless you have expressly opted-in by ticking the relevant checkbox on the entry form. You can unsubscribe at any time.

8.4       Winner Publicity: The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county or country of major prize winners to anyone who emails or writes to the address set out in Condition 1 (enclosing a self-addressed envelope) within 1 month after the Closing Date. Agreed.

8.5       If you object to any or all of your surname, county (and or country) and winning entry being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority (ASA) on request.

 

  1. ACCOMMODATION CONDITIONS AND HOUSE RULES

9.1       The winner’s occupation of the accommodation is subject to and conditional upon:

(a)        signing and complying with Timber Yard’s standard residential licence agreement or tenancy agreement (as applicable);

(b)        complying at all times with Timber Yard’s house rules, codes of conduct, and residential policies as amended from time to time;

(c)        complying with all applicable health and safety regulations and requirements;

(d)        maintaining the accommodation in good condition and repair (fair wear and tear excepted); and

(e)        respecting the rights and quiet enjoyment of other residents.

9.2       The Promoter reserves the right to terminate the winner’s occupation of the accommodation immediately and without compensation if the winner:

(a)        commits a material breach of the residential licence agreement, tenancy agreement, or house rules;

(b)        engages in antisocial behaviour, harassment, discrimination, or conduct that disturbs other residents or staff;

(c)        causes damage to the accommodation or common areas beyond normal wear and tear;

(d)        uses the accommodation for any illegal purpose or activity;

(e)        sublets, assigns, or otherwise allows third parties to occupy the accommodation without prior written permission from the Promoter;

(f)         fails to pay any charges or costs for which the winner is responsible under these terms and conditions or the residential agreement;

(g)        provides false or misleading information in connection with the competition or prize acceptance; or

(h)        fails to maintain valid immigration status or legal right to reside in the UK (for international winners).

9.3       The winner acknowledges that the accommodation is part of a managed residential community and agrees to comply with all reasonable requests and instructions from Timber Yard management regarding conduct, access, maintenance, and use of facilities.

9.4       A copy of Timber Yard’s full house rules and residential terms and conditions will be provided to the winner upon notification and must be signed and returned within 14 days of receipt. Failure to sign and return these documents within the specified timeframe will result in disqualification and the prize being offered to an alternative entrant. The winner cannot take up occupation of the accommodation until all required documentation has been completed and returned to the Promoter’s satisfaction.

 

  1. GENERAL

10.1      If the Promoter reasonably believes that there has been a breach of these terms and conditions, the Promoter may exclude the participant from participating in the competition.

10.2      The Promoter reserves the right to void, suspend, cancel, or amend the prize competition where it becomes necessary to do so due to circumstances outside of its reasonable control. In such circumstances, the Promoter shall notify participants as soon as reasonably practicable and, where prizes have been awarded or the competition has substantially commenced, shall use reasonable endeavours to provide alternative arrangements or compensation where appropriate.

10.3      These terms and conditions shall be governed by the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
